When you are faced with a diagnosis of mesothelioma cancer there are many resources are available for you and your family to benefit. You can seek for support from family and friends, as well as from health professionals, support groups, or your place of worship. Asking for support is one way you can feel in control of what’s going on in your life, your need for support is not a sign of weakness.

You feel lonely and abandoned. You may loose your desire to continue living . If your are not getting the much needed support from your friends and family then find others who can support you. There are probably others in your community who need your companionship as much as you need theirs. The mutual support of others with cancer might also be a source of comfort.You will probably need the support of different support groups to help you cope with the diagnosis of mesothelioma cancer.

What are different types of support groups?

There are different types and formats for support groups, there are individual, group counseling and support groups. Some support groups are formal and focus on learning about cancer or dealing with feelings. There are also less formal and more social groups. Some groups consist mainly of people with cancers or only caregivers, while others include spouses, family members, or friends. Other groups focus on certain types of cancer or stages of disease like mesothelioma cancer. Some groups have their meetings over a number of weeks while some others meet over a longer period of time. Some programs no longer accept new members while other groups are still open to new members.

Health professionals (a social worker, nurse, or other licensed professional), trained facilitators, or a group member may lead the group. The leader of a group should have some type of training before taking charge of a support group.

Telephone counseling groups

For those who cannot attend meetings or appointments, counseling over the telephone is offered by organizations such as Cancer Care, Inc. Some people may find online support groups helpful because they like the privacy. It may be comforting to chat with other people facing situations much like yours. But keep in mind that chat rooms and message boards are not the best source of cancer information, especially if they are not monitored by trained professionals or experts.

No matter what kind of group it is, everyone taking part should feel comfortable in the group and with the facilitator. If you have any fears or uncertainties before entering a group, try to discuss them with the group’s facilitator ahead of time.

Along with support programs, other means of support may be available in your community such as:
?Home health nursing services
?Social services, such as counseling and financial aid
?Nutrition services that provide meals or allow you to talk with a registered dietitian
?Rehabilitation services provided by physical and occupational therapists
?Spiritual services from chaplains or religious figures in the community
Support in any form allows you to talk about your feelings and develop skills to cope with the changes taking place in your life. Some studies have found that people who go to support groups have an improved quality of life, including better sleep and appetite.

Self-help groups

Self-help groups are most often run by non-professionals who have been through the same kinds of problems or crises. The people in these groups can relate to your experience firsthand and often have treatment-related tips and advice that may help you. For example, they may offer a home remedy that helped with their nausea, or know where to get the best prices on wigs and turbans. If their family members are not in the group, patients are free to express exactly how they feel. Family members can also benefit from sharing their feelings, fears, and anxieties with other families affected by mesothelioma cancer.

Self-help groups also give people recovering or who are long term survivors of mesothelioma cancer help others with the cancer. With some training, many people with cancer have found that helping others makes them feel better about themselves. They may go on to become group counselors or facilitators.

Choosing when to take part in a support group is vital. Some find it hard to join a support group when they are first diagnosed. The tales that other patients may share, after months or even years of treatment, can be overwhelming and upsetting. If you try a group and it doesn’t feel right, you may want to try again later or try another group.

Religion

Religion can be a source of strength for some people. Some find new faith when diagnosed with cancer. Others find their cancer experience strengthens their existing faith or their faith gives them newfound strength and hope. Others who have never had strong religious beliefs may not feel an urge to turn to religion at this time. A minister, rabbi, other leader of your faith, or a trained pastoral counselor can help you find spiritual support. Some members of the clergy are specially trained to minister to people with cancer and their families. Some hospitals also have chaplains available.

Question your health care team about the resources available at your hospital. You can also contact your American Cancer Society to find out about sources of support that are available in your community.

I have been diagnosed with mesothelioma. Should I see a solicitor?

Yes, if at all possible, as medical experts estimate that approximately 95% of all mesothelioma cases are caused by exposure to asbestos (usually in the workplace) and, more often than not, someone else (be it an employer,factory owner, or asbestos manufacturer) is to blame. Often people say” but, no one knew of the risks in those days; it was so long ago”, and place off the thought of taking legal advice, assuming nothing can be done. In actual fact, more often than not, there is a legal remedy, even if an employer has apparently stopped to exist. Therefore, it is unsafe to assume that no legal action can be taken.

-Do I need to see a solicitor straight away?

Depending on the treatment you are receiving and how you are feeling, it is wise to take legal advice as soon as you possibly can as there are time limits for all personal injury claims. As a general rule a court action(“proceedings”) must be started within 3 years of the diagnosis (or from the time you first suspected that you are suffering from an asbestos related disease). Although the Court has a discretion to set aside the 3 year”limitation period” (as it is called), technically your claim would be time barred if you did not issue proceedings within the 3 years. In any event,given the poor prognosis, most people do not want to delay taking legal action. Since the civil justice system was reformed in 1999, claims do not tend to take as long as they did, but it is still possible to have a claim “expedited”, if the medical evidence suggests that someone’s life expectancy is very limited.

-Can I seek the services of any solicitor?

Most solicitors now tend to specialise; the days of the “general practitioner”are numbered. Even so, regrettably, some solicitors who are not experienced in this particular field do take on mesothelioma claims and that can have unfortunate consequences, especially as most employers’ liability insurance companies (on the other side) instruct specialist firms to defend such claims. In that situation, it would not be a level playing field.Therefore, it is always sensible to seek out a solicitor who specialises in asbestos related disease litigation. Before instructing a solicitor, it is always worth asking about his/her qualifications and track record. For example, are they members of the Law Society’s Personal Injury Panel and/or the College of Personal Injury Law (CPIL). How many asbestos related disease cases have they successfully concluded within the last 3 years? Is the person you are dealing with a qualified solicitor?

-How much will it cost me ?

Although Legal Aid is now rarely available for personal injury claims, the 3 main funding options are:
• Conditional Fee (“no win: no fee”) Agreement {contigency arrangement}
• Trade Union funding
• Legal expenses insurance
As a consequence of changes introduced by the Access to Justice Act 2000, pursuing a personal injury compensation claim should not cost you a lot of money. Most (excellent) solicitors offer a free initial interview, even if a home visit is required (as is often the case). The solicitor should then discuss the various funding options at the outset, before any claim is intimated. If you are in a trade union/professional association, or have legal expenses insurance cover, then you may not have anything to pay, subject to the terms of the union agreement, or legal expenses insurance policy.
If your solicitor is prepared to take the case on a “no win: no fee” basis, then you may have to pay a one off insurance premium (which is recoverable in the event of a successful claim). But, the insurance cover will protect you against the risk of having to pay the other side’s costs in the event that the claim is lost or discontinued (provided court proceedings have been started). If you are successful, then the opposing party/insurance company will pay the claimant’s basic legal costs and also a “success fee” in addition.
Following the introduction of the new rules,relating to costs, claimants are now in a much better position than they were and you may not have to pay anything at all if the solicitor operates a “no cost to you” policy. But, be aware that some firms/organizations offering “no cost” policies/deals may not necessarily have the relevant expertise, as they mainly deal with “quick track” (low value) personal injury claims. Industrial disease claims are complex and require skillful handling. [*This is the lawyers reward for taking the case on and facing the possibility that he/she will not be paid anything at all if the case is lost]

-I have not received a definitive diagnosis, but I have been told that I probably have mesothelioma, should I seek the services of an attorney even though the diagnosis is not 100% confirmed?

This cancer is a very hard disease to diagnose accurately as most of its usual symptoms also occur in a lot of other common lung and abdominal diseases. Doctors are sometimes not 100% certain even when they have a strong clinical diagnosis. Legal claims for hurts can be proven on the balance of probabilities {that is more likely than not}, so if there is a strong probability medically that you have mesothelioma, you should seek the services of a solicitor who will investigate your claim. The limitation period in most places start from the time there is a reasonable suspicion of asbestos related disease and not from when a 100% confirmed diagnosis is made, so it very wise to seek for legal representation quickly and your attorney will advise you on the necessary steps to take.

Many people believe that to suffer from the deadly duo of asbestosis or mesothelioma you had to have had direct contact with asbestos products,for example you may have worked in an asbestos factory or used asbestos in construction or building work. But many people are diagnosed with this tragic condition who may have never seen or touched an asbestos product in their life. So how do they manage to contract these deadly and fatal diseases of the lungs. Here are some examples from newspapers all over the world.

This first example is from the Hebden Bridge Times in the UK.

“A woman whose parents worked at the Cape Asbestos factory, Ancient Town, died of mesothelioma – the cancer caused by the deadly mineral. An inquest into the death of the woman heard the disease also claimed the life of her brother. The siblings’ parents had worked at Acre Mill, as spinners during the 1950s and 1960s. The children were exposed to asbestos at Christmas parties held in the factory’s canteen, the Halifax inquest heard. There was no evidence the woman, a retired cleaner, had encountered the mineral during her own employment. She was diagnosed with malignant mesothelioma in 2007. She died aged 57 at her home in Master Lane, Halifax, on April 7, 2010. Her older brother, who had went to the USA, died aged 47 from the same disease.” In a compensation claim before her death, Mrs Shirley recalled picking bilberries and blackberries on moorland near the factory as a child, where there would be “white dust and fluff blowing about”.The siblings were also exposed to asbestos in their family’s van and from dust on their parents’ clothes, the inquest heard.

Here`s another case from Australia that was reported on the asbestos.com website.

“According to a recent lawsuit filed in Queensland, Australia, an ex-teacher aide is seeking compensation after being exposed to asbestos during the 1980s and developing mesothelioma. During the time she was working at a State Pre-School in 1983, the school was undergoing renovations to meet enrollment demands. Throughout the construction, classes continued even though the presence of asbestos had been confirmed.”

And finally here`s another tale from the UK that was published on the ContractorsCompare.com website.

“A former care home manager could have developed mesothelioma after coming into contact with asbestos dust on her husband’s clothing. The West Dorset coroner said the woman aged 77, could not remember being in close contact with asbestos dust, the Bournemouthecho.co.uk reported.
The woman, but, did hug her husband and wash his clothes after he was employed turning a poultry house into a new piggery.

According to the coroner, the woman, of Charlton Marshall, recalled her farm manager husband returning home with asbestos dust on his clothes, hair and eyebrows while he was carrying out the renovations.

The woman died at Dorset County Hospital this year and her demise was recorded as being a result of “environmental exposure” to the substance, the coroner ruled.”
